POPIA & PAIA Compliance: Why it Matters for Your Business

Protection of Personal Information Act, 4 of 2013
Almost all businesses will, at some point, have to collect, store, process, and handle personal information. POPIA aims to set out conditions for the lawful processing of personal information, and the Information Regulator imposes hefty penalties for non-compliance.
As of February 2024, the Information Regulator has already issued an enforcement notice, following its formation in 2016.
Failure to comply with the Act, whether through intentional or negligent wrongdoing, can result in administrative fines of up to R10 million or 10 years imprisonment.
To stay up-to-date and compliant, businesses ought to consult with an attorney or compliance specialist au fait with the provisions of the Act. Businesses should ideally appoint deputy information officers to manage this compliance risk and to ensure that they can build a secure and stable infrastructure within the company to maintain and protect personal information in its possession.
Companies should have various documents, including a POPIA manual, privacy policy and processing of personal information framework to ensure that their compliance is satisfactory to the Information Regulator.
POPIA cannot exist in isolation and must be read in conjunction with the provisions of the Promotion of Access to Information Act, 2 of 2000 (“PAIA”). PAIA aims to promote access to information and POPIA is concerned with privacy and avoiding information disclosure. These two pieces of legislation ensure proper information management and data processing.
